1. Acceptance of these terms
These Terms of Use ("Terms") govern access to and use of www.trinityenvgroup.com and pages that link to these Terms (the "Site"), provided by Trinity Environmental ("Trinity," "we," "us," or "our"). By accessing or using the Site, a visitor agrees to these Terms. A visitor who does not agree should not use the Site.
2. Informational purpose; no service agreement
The Site provides general information about Trinity, its capabilities, and environmental compliance and field services. Site content is not a proposal, quote, guarantee, professional opinion, or agreement to provide services. Any project engagement, scope, pricing, schedule, deliverable, warranty, or allocation of responsibility must be stated in a separate written agreement signed by authorized representatives.
Site content is not legal, regulatory, engineering, geotechnical, safety, or other professional advice for a particular project. Requirements vary by jurisdiction, permit, site, and changing law. Visitors should obtain qualified advice appropriate to their circumstances.
3. Permitted use
Trinity grants visitors a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful informational and business-evaluation purposes, subject to these Terms.
A visitor may not:
- use the Site in violation of law or the rights of another person;
- attempt to gain unauthorized access to the Site, servers, accounts, or connected systems;
- introduce malware, interfere with operation, probe for vulnerabilities, or bypass security controls;
- use automated methods to scrape, harvest, or copy Site content at a volume that burdens the Site or violates applicable law;
- misrepresent an affiliation with Trinity or use Trinity's name, branding, or content to imply endorsement; or
- reproduce, distribute, modify, sell, or exploit a substantial portion of the Site except with Trinity's written permission or as allowed by law.
4. Intellectual property
The Site and its text, layout, graphics, logos, photographs, videos, icons, and other content are owned by or licensed to Trinity and are protected by intellectual-property and unfair-competition laws. Trinity and related names, logos, and marks may not be used without permission. No ownership right is transferred under these Terms.
5. Communications with Trinity
Email and telephone links are provided for convenience. A message does not create a client, contractor, consulting, fiduciary, or other professional relationship, and it does not obligate Trinity to accept work. Ordinary email may not be secure. Visitors should not send confidential, regulated, or sensitive personal information unless Trinity has agreed to an appropriate communication method.
6. Third-party links and services
The Site may link to third-party websites or services, including maps, LinkedIn, email applications, and Google services. Links are provided for convenience and do not necessarily imply endorsement. Trinity does not control and is not responsible for third-party content, availability, security, terms, or privacy practices.
7. Site availability and changes
Trinity may update, suspend, restrict, or discontinue any part of the Site at any time. Trinity does not promise that the Site will be uninterrupted, error-free, complete, current, or compatible with every device or browser. Trinity may correct errors but is not obligated to update every item immediately.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TRINITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRINITY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM RELIANCE ON SITE CONTENT OR INABILITY TO USE THE SITE. TRINITY'S TOTAL LIABILITY ARISING FROM THE PUBLIC SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE A DIFFERENT LIMIT IS REQUIRED BY LAW.
10. Privacy and cookies
Trinity's Privacy Policy explains how information is handled. The Cookie Policy explains cookies and similar technologies. Those policies are incorporated into these Terms by reference for purposes of Site use.
11. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to applicable law, disputes relating to the Site will be brought in the state or federal courts serving the Texas county in which Trinity's principal office is located.
12. Severability; waiver; assignment
If a provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. A visitor may not assign rights under these Terms without Trinity's consent; Trinity may assign these Terms in connection with its business or assets.
13. Changes to these terms
Trinity may revise these Terms by posting an updated version with a new effective date. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
